1. Services

805 Maverick provides AI-powered virtual receptionists, website chat agents, automated lead follow-up, and related business automation services. Specific deliverables, pricing, and service levels are defined in the individual service agreement or proposal signed between you and 805 Maverick.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to active clients.

2. SMS & Text Messaging Consent (A2P 10DLC)

• Opt-out: Reply STOP to any message to unsubscribe at any time. You will receive a confirmation opt-out message.
• Help: Reply HELP for assistance or contact 805maverickai@gmail.com.
• Carrier support: Supported carriers include AT&T, T-Mobile, Verizon, and other major U.S. wireless carriers. Availability is not guaranteed on all networks.

We do not use purchased, rented, or affiliate lead lists for SMS outreach. SMS messaging is initiated only to individuals who have provided explicit opt-in consent or with whom we have an existing business relationship. Originator opt-in data and consent are not shared with any third parties other than aggregators and providers of the text message services used to deliver messages.

You affirm that the mobile number you provide belongs to you or that you have the account holder's permission to receive messages at that number. You are responsible for any charges imposed by your carrier.

3. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Send unsolicited spam or non-compliant SMS messages through our platform
• Attempt to access, disrupt, or compromise our systems or another user's data
• Resell or sublicense our services without written permission
• Use our services to contact individuals who have not consented or who have opted out

Violation of these terms may result in immediate suspension or termination of your account without refund.

4. Accounts & Billing

You are responsible for maintaining the confidentiality of any login credentials and for all activity under your account. Invoices are due per the terms stated on your invoice. Late payments may result in service suspension.

Payment transactions are processed by PCI-compliant third-party processors. We do not store full credit card numbers on our servers.

5. Intellectual Property

All content, branding, software, and materials provided by 805 Maverick remain our intellectual property. You retain ownership of all content and data you provide to us for processing. You grant us a limited license to use your data solely to provide the services you have engaged us for.

6. Data & Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using our services you consent to the data practices described there.

7. Service Limitations

AI-generated responses and automated systems may occasionally produce inaccurate or unexpected results. 805 Maverick is not liable for damages arising from reliance on automated outputs. SMS delivery is dependent on third-party carriers and is not guaranteed. We are not responsible for messages blocked, delayed, or filtered by carriers.

8. Disclaimer of Warranties

Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee uninterrupted or error-free service.

9. Limitation of Liability

To the maximum extent permitted by law, 805 Maverick shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of revenue, profits, or data arising from your use of our services. Our total liability shall not exceed the amount you paid us in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless 805 Maverick from any claims, damages, or expenses arising from your misuse of our services, your violation of these Terms, or your infringement of any third-party rights — including non-compliant SMS messaging initiated at your direction.

11. Termination

Either party may terminate services with notice as defined in your service agreement. Upon termination, we will discontinue active services. SMS campaigns will cease immediately. Provisions regarding liability, intellectual property, and indemnification survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Ventura County, California.
